Back in October 2023, Hard Air Magazine first brought you news about the FX Airguns USA court case. At the time, I predicted that – given the complexity of this case – that it would run for some time before there’s a resolution.
Well, nine months later, it’s still running!
Indeed, the public court records reveal an amazing number of twists, turns and unexpected happenings. All of this is waaaaay too complicated for me to attempt to summarize!
However here’s a few definite outcomes that are covered in recent FX Airguns USA court case documentation…
1. As of the end of June, the costs for FX Airguns USA’s Receiver, plus expenses and his legal counsel exceed $330,000 in total and are still increasing. (Sum of multiple compensation claims by the Receiver).
Remember that this does NOT include the legal costs for any of the people and entities involved – FX Airguns Sweden, FX Airguns USA, Rumpgarden, Everly Holdings, etc.. They would all be additional.
Just imaging what the total of the legal bills must be. Ouch!
2. The official US distributor for FX Airguns and Element Optics is now Marksman Distribution of Orem, Utah. (Shown on the website).
3. The Hall Watters Drive warehouse and offices of FX Airguns USA has been sold. (Shown in General Receiver’s Third Interim Report, July 16, 2024).
4. The bulk of the remaining airguns, optics, ammunition, components, and repair parts at FX Airguns USA were sold to FX Airguns, Sweden. (Shown in General Receiver’s Third Interim Report, July 16, 2024).
5. In addition, Cape Fear Airguns will sell, on a consignment basis, some airguns, optics, ammunition, components, and repair parts not being sold to FX Sweden. (Shown in General Receiver’s Third Interim Report, July 16, 2024).
6. The Receiver also continued to engage in settlement negotiations with counsel for Jonathan Tueller, Evelyn Elvegaard, and EverGuard Holdings, in an effort to reach a comprehensive out-of-court resolution of remaining claims. (Shown in General Receiver’s Third Interim Report, July 16, 2024).
The FX Airguns USA Court Case
On October 3, 2023, a law suit was filed in the General Court of Justice, Superior Court Division, State of North Carolina, County of Wake. Case Number 2023CVS27939. In it, the plaintiff requests that a General Receiver be appointed for FX Airguns USA, to take control of the company.
